Georgia Law: Under O.C.G.A. § 48-4-5, the county must hold excess funds for five years after the tax sale. After that, unclaimed funds are turned over to the Georgia Department of Revenue, and getting them back requires a court order. Don't let the clock run out on what's legally yours.

Frequently Asked Questions

What Georgia law covers surplus funds?

How long do I have to claim surplus funds in Georgia?

The county holds tax sale excess funds for five years from the sale date. After that, unclaimed funds go to the Georgia Department of Revenue, and they can only be released by a court order from an interpleader action filed in the county where the sale took place.
